These Terms of Service ("Terms") govern your access to and use of the Franky mobile app, website at franky.fit, and related services (collectively, the "Service") provided by Franky ("we," "us," or "our"). By accessing or using the Service, you agree to these Terms.

Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you may use the Service only with the consent of a parent or legal guardian.

Your Account

Some features may require you to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly if you believe your account has been compromised.

Description of the Service

Franky provides fitness coaching, workout guidance, and related tools designed to help you train more effectively. Features may include voice interaction, optional visual coaching tools, workout tracking, and personalized feedback. We may add, modify, or remove features at any time.

Device Permissions

Certain features of the Service require permission to access your device microphone or camera. By granting permission, you authorize Franky to use those inputs only for the features you choose to use.

• Microphone: Used for voice-based coaching, spoken commands, and hands-free interaction during workouts. You may deny or revoke this permission in your device settings.
• Camera: Used only when you request features that require visual input, such as optional form checks or movement tracking. Camera access is not required for basic use of the Service and may be denied or revoked at any time.

If you revoke a permission, related features may stop working, but your right to use other parts of the Service is not affected.

Acceptable Use

You agree not to:

• Use the Service in any unlawful manner or for any unlawful purpose.
• Attempt to reverse engineer, decompile, or interfere with the Service or its systems.
• Upload, transmit, or share content that is harmful, abusive, infringing, or misleading.
• Misrepresent your identity or impersonate another person or entity.
• Use the Service in a way that could damage, disable, or overburden our infrastructure.

Health and Fitness Disclaimer

Franky provides fitness guidance and coaching tools for informational and motivational purposes only. The Service is not a substitute for professional medical advice, diagnosis, or treatment. Consult a qualified healthcare provider before starting any exercise program, especially if you have a medical condition, injury, or concern about your physical ability to exercise.

You assume all risks associated with your use of the Service and any workouts or activities you perform. Stop exercising and seek medical attention if you experience pain, dizziness, shortness of breath, or other symptoms of concern.

User Content

You may provide content through the Service, including workout data, voice input, or images captured through optional camera features. You retain ownership of your content, but you grant us a limited license to use, process, store, and display that content solely to operate and improve the Service as described in our Privacy Policy.

Intellectual Property

The Service, including its software, design, branding, text, graphics, and other materials, is owned by Franky or its licensors and is protected by applicable intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, sell, or create derivative works from any part of the Service.

Third-Party Services

The Service may integrate with or link to third-party services. We are not responsible for third-party services, and your use of them is subject to their own terms and policies.

Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, if we are required to do so by law, or if we discontinue the Service. Sections that by their nature should survive termination will continue to apply.

Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

Limitation of Liability

To the fullest extent permitted by law, Franky and its affiliates, officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim arising out of these Terms or the Service will not exceed the amount you paid us, if any, for the Service in the twelve months before the event giving rise to the claim.

Indemnification

You agree to indemnify and hold harmless Franky from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, your content, or your violation of these Terms.

Governing Law

These Terms are governed by the laws applicable in our principal place of business, without regard to conflict of law principles. Any disputes will be resolved in the courts located in that jurisdiction, unless applicable law requires otherwise.

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
